SM Ent. refutation, They made 11b KRW after debut
SM Entertainment, with which Dong Bang Shin Ki member Hero JaeJoong, Micky YooChun and Xiah JunSu has have a dispute with, came out to reveal their official stand.
SM Entertainment said on 3rd August, Dong Bang Shin Ki has earn 11billion KRW from after their debut till 2009 July (dividend payout 9.2 billion KRW + beforehand provision 1.77 billion KRW). Also they also received many high-end foreign products in the process even though SM Entertainment was suffering from a business deficit in the 4 years after the groups debut. And even though there is a distributive ratio, they would have raised it with proftis from their endorsement in CFs, doing events and also photoshoots.
And about how the 3 members have said that they were given unjust treatment, SM Entertainment said, About their health and schedule, we have discussed them before they were put through it.
And about the cosmetic enterprise, SM said, Looking at this case, this holds substantial reasons to it. It is evident since there is only 3 members involved in this case. They wanted to reduce the loss of image and harm to them as soon as possible with this plan as they will be used for the enterprise in terms of having their images used as part of marketing and also to participate in events for the enterprise.
Also, According to the Fair Trade commission, there is no provision saying that singers cannot be signed for beyond a period of 7 years, and there is no exceptional provision limiting the contract of singers promoting overseas. We did amendments to the exclusive rights clause for 5 times after the contract was contracted, 2 times were to address the compensation of loss, and after checking and confirmation by the Fair Trade Commission. The rest of the 3 times were to address the profits distribution ratio and for renewal in 2004 January, then in 2007 February and 2009 February.
SM We will solve this case with the 3 members regarding the application for retractile in the contract and the lawsuit confrontation as soon as possible.

시아준수 아버지 문제의 발단 폭로.. 동방신기 '5년 해체 징크스' 결과는?
[아츠뉴스=김승기 기자] 3일 방송된 SBS '배기완 최영아의 좋은아침-생방송 연예특급'에서는 '해체 위기' 동방신기, 그 속사정은 무엇? 이라는 주제로 다루었다.
동방신기 멤버 영웅재중, 시아준수, 믹키유천이 지난 7월 31일 서울 중앙지방법원에 소속사 SM엔터테인먼트를 상대로 전속계약 효력정지 가처분 신청을 했다.
이에 SM엔터테인먼트 측은 8월1일 "시아준수, 영웅재중, 믹키유천이 제기한 전속계약 효력정지 가처분 신청이 접수된 것을 확인했고 이에 매우 안타깝고 당혹스럽다.
동방신기가 개인 혹은 일개 기업만이 아닌 국가 및 아시아를 대표하는 그룹이기 때문에 동방신기의 활동은 지속되어야 한다는 입장이다"라며 "화장품 회사와 관련하여 발생한 이번 문제에 대해 조속히 대처해 나갈 예정이다"라고 공식 입장을 발표했다.
동방신기의 다른 2멤버 유노윤호와 최강창민은 이번 소송에 동참하지 않았고, 소속사에 남기로 결정한 것으로 알려졌다.
연예특급 제작진은 시아준수 아버님을 찾아가 화장품 사업과 관련해 질문을 던졌다.
시아준수 아버지는 "그것은 오보된 내용이고, 그거랑 상관이 없다"라며 "애들이 계약서 때문이지"라고 입을 열었다. 이어 "변호사님들이 보도 자료 나갈 거예요. 제 생각에는... 그것은 아니에요"라고 덧붙여 설명했다.
드라마 캐스팅에서 멤버 간 형평성에 대해서 시아준수 아버지는 "애들이 연습생까지 7년, 8년, 10년인데..."라며 "제가 말씀드릴 수 있는 것은 SM하고 애들하고 계약 조건이나 그런 문제점이 발생해서 SM 쪽에 얘기했는데 그쪽에서는 구체적인 답변이 없고 시간이 흐르다 보니까.."라고 문제의 발단을 폭로했다.
한편, 2004년 데뷔 이후 아시아를 넘나들며 최고의 위치에 서 있는 동방신기가 데뷔 5년 만에 갈등과 불화로 선배 아이돌이 걸었던 '5년 해체 징크스'가 닮아있어 팬들의 마음을 안타깝게 하고 있다.

Troubled about this T_T
SM's side of the story (straight from the mouth of their representatives):
•They admit that there has been some disagreement between them and DBSK recently but they are 'shocked' that DBSK took the issue to court.
•They are currently having an emergency meeting and will release an official statement soon.
While DBSK probably makes the most money in SM Entertainment, don't think for a second that SM Entertainment is smart enough to keep them. Look at H.O.T. (LSM denied they were breaking up when articles began to appear about them breaking up just like they are now about DBSK; a few days later H.O.T. announced they were breaking up) and Shinhwa (SM only wanted to negotiate new contracts with two of the members; they are amazing for being able to leave SM Entertainment TOGETHER and buy the name Shinhwa from SM Entertainment).
On the other hand, note that the three asked to be released from their current contracts. This doesn't necessarily mean that DBSK are breaking up or that the members are leaving SM Entertainment (they could sign new contracts).
The only thing you can be sure of is the fact that the three members are not happy with their current contracts and would like to be released from them

disposición (nota: no un juicio aún) pidiendo a SM
que los libere de sus contratos. Yunho y Changmin
no están involucrados. Este NO ES SOLO UN RUMOR ES
UN HECHO. Lo que queda como rumor esla disolución
de DBSK, aunque si los 3 ganan (lo que puede ser
muy posible que pase) entonces es una posibilidad.
"DBSK" y la "Disposiciñon de DBSK" está siendo un
tema de mucho habalr en los portales coreanos en
este momento y atrñiculos siguen siendo subidos y
parece que SM está removiendo posts antiguos por
los miembros en su web oficial.
El lado de la historia de Jaejoong, Junsu y
Yoochun (lo que dijo su abogado directamente):
•Los 3 miembros y el abogado han estado en
contacto discutiendo este problema por más de 2
meses ya.
•Ellos trataron de negociar con SM Entertainment
para rsolver este problema de la mejor manera
posible pero no pudieron llegar a un acuerdo.
• Por lo tanto, se vieron obligados a solicitar
una disposición provisional, el 31 , contra SM
Entertainment para liberarlos de sus contratos.
• Las principales razones para querer ser
liberados de sus contratos incluyen el hecho de
que sus contratos eran básicamente como Contratos
para esclavos.
• Sus contratos son por 13 años.
• Sus ingresos se dividen 8:2 o 9:1 (con el menor
número para los cinco miembros y el mayor número
para SM Entertainment. A comparación, JYP
Entertainment divide 5:5 con sus grupos (inclusive
con los nuevos.)
• * Otras razones mencionadas, aunque no por el
abogado, los miembros se incluyen exceso de
trabajo y SM Entertainment no están contentos con
la realización de negocios que los tres miembros
han empezado con sus padres.
• Si SM no los libera de sus contratos, ellos
están dispuestos a presentar una demanda e ir a
juicio.
• Una declaración oficial sobre este tema se dará
a conocer por los tres miembros los antes posible.
El lado de la historia de SM (de la boca de sus
representantes):
• Ellos admiten que ha habido cierto desacuerdo
recientemente entre ellos y DBSK pero ellos estan
'conmocionados'(shockeados) con esto acerca que
DBSK lleve el tema a los tribunales.
• Ellos estan actualmete teniendo una reunion de
emergencia y se dará a conocer una declaración
oficial en breve.
